First came a federal court ruling upholding the Osage Minerals Council lengthy fight over a wind farm and now the Council has scored another ruling in favor of the tribal group in northern Oklahoma.
The tribe found itself in a 10-year legal fight in which it challenged the Bureau of Indian Affairs’ National Environmental Policy Act review of two leases on the Osage Minerals Estate, reported Osage News. A Northern District federal judge recently ruled in favor of the Council.
The legal fight involved challenges to leases brought on behalf of Paul Hayes, who owned 475 acres of surface land in Osage County. The tribe contended the BIA failed to conduct a NEPA analysis and the court agreed.
