A federal judge is being asked to finalize the case brought by the Osage Indian tribe and the federal government against Enel Energy for its alleged illegal construction of more than 80 wind towers in Osage County. It is a legal fight that started several years ago.
US government attorneys and those for the Osage Minerals Council, informed Judge Jennifer Choe-Groves that negotiations had broken down with Enel. She is the judge who ruled last December that the Italy-based firm had improperly located more than 80 wind towers in the county in violation of tribal mineral ownership. She also ordered the removal of the towers, a process that has yet to begin.
Because the Osage tribe owns all of the mineral rights in Osage County, it claimed Enel illegally built the wind farm by digging below the surface.
The Bartlesville Examiner-Enterprise reported the Judge held a hearing to determine damages in the case but no ruling has been announced.
