A federal judge says Missouri’s rules aimed at limiting the impact of environmental, social and governance (ESG) policies are a violation of the first amendment.
U.S. District Judge Stephen Bough recently struck down the rules and in doing so, also agreed with the Securities Industry and Financial Markets Association in an order on all four counts, saying that the rules not only violated the First Amendment but were also unconstitutionally vague and preempted by multiple federal laws.
His order is a reminder of a similar ruling by Oklahoma County District Judge Sheila Stinson who came down with a decision against Oklahoma’s own anti-ESG law which banned state agencies from doing business with firms that descriminate against the oil and gas industry.
