West Texas oil and gas interests were successful in stopping a temporary nuclear waste storage facility.
Their victory came when the three-judge panel of the New Orleans-based 5th U.S. Circuit Court of Appeals canceled a license granted in 2021 by the U.S. Nuclear Regulatory Commission. The Court determined the NRC lacked the authority under federal law to issue permits for private, temporary nuclear waste storage sites.
