Five Oklahoma congressional members were among hundreds of Republicans who joined a lawsuit asking the Supreme Court to restrict the Biden administration’s authority under the Clean Water Act.

Sens. Jim Inhofe and James Lankford along with House Members Stephanie Bice, Kevin Hern and Markwayne Mullin filed an amicus brief  in the case that centers around an Idaho couple who have fought the government for years whether they need a Clean Water Act permit to fill in wetlands on their property.

The 45 Republican senators and 154 representatives contend along with  Michael and Chantell Sackett, the federal government should take a narrower view to determine what waters should fall under the Clean Water Act.

They also argued that “States retain their traditional role as the primary regulators of land and water resources, and that farmers, manufacturers, small business owners, and property owners like the Petitioners in this case can develop and use their land free of over-burdensome, job-killing federal regulations.”
