Colorado appeals court upholds Crestone’s right to drill in eastern Boulder County

 

Residents fighting proposed oil and gas drilling near Boulder, Colorado lost a round in court this past week when the Colorado Court of Appeals upheld a lower court ruling that allows Crestone Peak Resources to continue with fracking plans.

 

According to the court’s opinion, the county’s appeal centers on one question: What constitutes “production” under an oil and gas lease?

The ruling came in a 2018 lawsuit filed by Boulder County against Crestone. The county contended wells subject to two of Crestone’s oil and gas leases had stopped producing, terminating the company’s leases reported the Boulder Daily Camera.
