A legal fight between two Colorado companies over the quality of sand and gravel from operations near Pueblo has led to a U.S. Court of Appeals Tenth Circuit ruling.
Continental Materials Corporation went to court to end the contract with Valco, Inc. after it stopped making lease payments when it determined the sand and gravel excavation didn’t meet a required ratio. Valco counter-sued.
A District court granted summary judgment to Valco on all but one of Continental’s claims. It led to an appeal by Continental but this week, the federal appeals court in Denver ruled it lacked appellate jurisdiction and dismissed the case.
