Energy Transfer is fighting the federal government over its enforcement of the U.S. pipeline safety law and a multi-million dollar fine from a fatal accident on its Panhandle Eastern gas pipeline.
The 2020 accident happened in Kansas not far from where the pipeline starts in Amarillo, Texas.
The Dallas-based company, with offices also in Oklahoma City filed suit earlier this year against the Pipeline and Hazardous Materials Safety Administration asking a judge to call the agency’s enforcement system “unconstitutional.” It is a challenge of a $2.5 million fine levied by PHMSA over a fatal accident five years ago on its Panhandle Eastern natural gas pipeline.
The lawsuit was filed in the Amarillo Division of the federal court system.
