The U.S. Supreme Court will hear arguments Tuesday morning on opposition to an 88-mile proposed railway to carry oil from Utah and across Colorado—oil that in some cases is intended for Oklahoma’s Cushing Hub.
Analysts and some environmentalists wonder if the eventual decision will drastically change how projects are permitted nationwide.
Ever since the Unita railway was proposed, it drew opposition from first one western Colorado county, then another and another and eventually the state of Colorado.
Seven Utah counties appealed a U.S. Court of Appeals decision and it’s now before the Supreme Court where the National Environmental Policy Act which is used for evaluation of the impacts of a project will be considered.
