In a case that raises the subject of ROFRs or Right of First Refusal, a federal judge has blocked a 2023 Indiana law that gives in-state utilities first rights to build new transmission projects, saying it limits competition for out-of-state companies.
The idea of ROFRs has floated around the Oklahoma legislature for the past few years and while a ROFR attempt last year failed, there is word that supporters are quietly attempting to build support for another attempt in the 2025 session.
ROFR was not mentioned in the Indianapolis case, at at least in the newspaper coverage, but if it walks like a duck and talks like a duck, well, ROFR is there somewhere. The federal judge ordered a suspension of the Indiana law passed in 2023 that gives the state’s major utilities the right of first refusal for electric transmission projects…..ROFR, right?
