While controversial “Right of First Refusal” efforts in the Oklahoma legislature are dead this session, similar moves remain alive in the Kansas legislature and elsewhere.

It’s an effort that could affect the cost borne by taxpayers for new transmission lines not just in Kansas but across the nation.

Other efforts are underway in other states, Missouri, Mississippi and Montana, as utilities reportedly applied pressure on legislators. Indiana is considering a measure to expand its existing ROFR law and legislation is anticipated in Wisconsin reported E&E News.

After a 2011 ruling by the Federal Energy Regulatory Commission eliminated the federal ROFR for regionally planned power lines, the issue was left in the hands of the states. And they are responding.
