Environmental group loses challenge in Missouri

A Missouri environmental group that has filed suits against the EPA, the Army Corps of Engineers and the state of Missouri has lost an appeal with the U.S. Supreme Court.

The high court recently upheld a lower court’s decision to dismiss the petition of the Missouri Coalition for the Environment challenging the makeup of the Missouri Clean Water Commission.

The state argued the Coalition could not prove taxpayer standing—that is it could not make a case to show it would be affected by an amendment to state law regarding the makeup of the commission. The amendment provided that at least two members of the 7-member board “shall be knowledgeable concerning the needs of agriculture, industry or mining.”

The Supreme court ruled the coalition could not show the potential changes to the commission threatened or actually injured the coalition.
