Regulators to discuss OGE’s recusal request for Commissioner Todd Hiett

 

The feud between Oklahoma Gas and Electric and Corporation Commissioner Todd Hiett could come to a head Thursday when the commissioners meet to discuss the utility’s request for Hiett to recuse himself from its rate case for expanded electric generation projects.

The recusal request, filed before Thanksgiving, accused Hiett of impartiality against OGE and partiality in support of the consumer group known as OIEC or Oklahoma Industrial Energy Consumers.

Commissioner Hiett will have his first opportunity for a public response to the growing fight with OG&E. He did not respond to a request from OK Energy Today.

As the agenda for the meeting states, there will first be the handling of OGE’s request for Preapproval of New Generation Capacity and Rider Cost Recovery (Case No. PUD2025-0000038).

The recusal issue will follow but it does not reflect that any vote on the request will be made.

Afterward, the commission is to hold a discussion with a possible vote on the motion of the Oklahoma Industrial Energy Consumers and AARP to reconsider and modify the commission’s order supporting some of OG&E’s original request.

Order No. 753440 is not in the public interest; it authorizes OG&E’s acquisition of capacity that will result in electric rates that are unfair to OG&E’s customers and that are not the lowest
reasonable rate,” argued the two groups in their filing.

They further argued, “The Commission’s Order is deficient and very one-sided, citing almost exclusively to the testimony of OG&E’s witnesses, giving the appearance that it was written by OG&E.”

 It was the same argument that Commissioner Hiett made during the commission meeting where the vote was made. He contended OG&E came in after Commissioner Brian Bingman’s original motion and after the case was closed from further testimony and helped write the final product, something later denied by Commissioner Bingman’s office.

The utility was still angry over Hiett’s opposition last month when he voted against some of its proposed projects. OG&E stated its reason for the recusal request was “for his prior prejudicial and inflammatory statements through which he has shown a clear animus against OG&E, depriving OG&E of the fair and unbiased participation by Commissioner Hiett.”

The utility accused the commissioner of making a series of statements that demonstrate a clear bias against OG&E. It also cited a list of his purported statements to support its claims.

  • “[T]he language that OG&E has incorporated in this order that’s before us today is nothing more than monopoly propaganda for deregulation of the monopolies…I was shocked at the utility’s – that this utility OG&E would have the nerve to do so with their own regulators. But I – I probably shouldn’t be.” Case No. PUD 2025-000038, Tr. 11-13-25 at 13:25–14:8.
    “I probably shouldn’t be surprised that they would have the gall to climb up on the Commissioners’ Bench and completely rewrite a Commission order – after the record is closed and after the Commission – Commission has indication – indicated
    opposition to the – to the non-unanimous stip.” Id. at 14:23–15:4.

    “So, this is nothing more than the monopolies – once again, just like they have been doing at the Legislature, but now they are doing it at the Commission, they are trying to capture this regulatory body, utilize this regulatory body through an order
    to promote propaganda.” Id. at 15:5–10.

    “I am accusing the monopoly utilities of trying to execute regulatory capture in this state, both through legislative fiat and now taking over Commission orders at the last minute. And when I get an order that is – has been completely dismantled and rewritten with nothing but OG&E propaganda last night at eight or eight thirty at night, that – that is not a good move.” Id. at 17:24–18:6.

    “And the way – we should – we should – as Commissioners, we should stand up against that. We are the only – we are – we were designed by the Constitution to be the proxy for competition between the monopolies and the rate-payers. We are the only thing the rate-payers have.” Id. at 18:7–12

OG&E further charged that Commissioner Hiett appears to be “compromised” by the Oklahoma Industrial Energy Consumer and “repeats their talking points and espouses their views at every opportunity.” The organization is known as the Oklahoma Industrial Energy Consumers and not Consumer as OG&E claimed repeatedly in its filing.

It said Hiett has demonstrated “over and over again” that he is partial to the OIEC and will echo their talking points.

Oklahoma Gas and Electric meanwhile, faces serious allegations from the three Republican legislators who filed Supreme Court challenges to its rate hikes and votes involving Commissioner Hiett.

In their most recent filing, Reps. Tom Gann, R-Inola, Kevin West, R-Moore, and Rick West, R-Heavener accused OG&E of improper and possible unlawful influence over the hiring of an advisor for the Corporation Commission in its 2021 winter storm bond votes.

“Also disclosed was the fact that the OCC’s financial advisor for the securitization cases, Hilltop Securities, had been hired through a dubious RFP process apparently unduly (and possibly unlawfully) influenced by OG&E Vice-President (and former State Treasurer) Ken Miller and his deputy still at the State Treasurer’s office,” they stated in the filing.

Miller took a swipe at Hiett’s stance last month when he issued a statement following the 2-1 vote.

“I’ve known Todd for a long time and he has never responded well to not getting his own way,” he said in a statement. ““We take great offense to his characterization of OG&E’s advocacy for critical projects that meet Oklahoma’s growing demand for energy at low costs as highly inappropriate and unacceptable.”

The state representatives, Gann, West and West, also are challenging the rate increases based on Commissioner Hiett’s participation in the cases, saying he violated utility customers’ due process rights.

“Hiett cast the deciding vote to approve all the rate increases, even though we believe state ethics rules say he should not have participated,” Rick West said.
