DEQ board to consider rules changes

 

 

From lead paint rules changes to the code that must be met by employees, the Oklahoma Environmental Quality Board meets in a week in Stillwater.

The meeting will be held on the campus of Oklahoma State University and begin at 9:30 a.m. on Tuesday, September 9.

The Department is proposing to amend existing OAC 252:110, Lead-Based Paint Management: to update the incorporation by reference section (252:110-5-1); to remove an obsolete Section 252:110-13-7; and to make minor terminology revisions in Sections 252:110-3-1, 252:110-3-2, 252:110-13-2, and 252:110-15-1.

The proposed updates are necessary to remain consistent with the U.S. Environmental Protection Agency’s (EPA’s) updated Lead-Based Paint (LBP) program requirements and maintain EPA approval for Oklahoma’s LBP program. The practical result of this rulemaking is to replace obsolete rule provisions involving “clearance levels” by incorporating more up-to-date federal regulations by reference.

6. Executive Director’s Report – Robert Singletary, Executive Director, DEQ Mr. Singletary’s report may include significant agency accomplishments and activities since the last Board meeting, as well as information pertaining to budgetary and/or legislative matters. This report is for informational purposes only, and no action by the Board is required.

7. Budget Update and Financial Overview (FY 2026) – Kathy Aebischer, DEQ Director of Administrative Services Ms. Aebischer’ s report will include an update and overview of DEQ’s current budget for Fiscal Year 2026. This report is for informational purposes only. Although discussion may occur, no action by the Board is required.

8. DEQ Operational Budget Request (FY 2027) DEQ budget requests to the Governor through the Office of Management and Enterprise Services (OMES) require approval of the Board. The operational budget request for State Fiscal Year (SFY) 2027 (beginning July 1, 2026) must be submitted to OMES by October 1st of this year.

9. Employee Disclosures – Jonathan Allen, DEQ General Counsel

The Environmental Quality Code requires DEQ employees involved in reviewing, issuing or enforcing permits to disclose financial interests they hold in entities regulated by the DEQ. The DEQ is required to submit these disclosures to the Board and make them part of the minutes. This is for informational purposes only, and no action by the Board is required.
