An annexation fight is underway where a data center is opposed to being annexed by the city of Muskogee.
It’s led to a lawsuit filed by Polaris Technologies. The company went to Muskogee County District Court where it is asking a District Judge to issue an injunction against the city’s annexation ordinance approved last week. (Case No. CV-2025-0457)
The Polaris data center is in the John T. Griffin Industrial Park and was annexed along with three other properties in the park. Polaris contends the ordinance was approved without mailing a notice of annexation. A report by the Muskogee Phoenix says the Muskogee City Attorney “vigorously denies” the claims of the lawsuit.
Polaris Technology, a crypto data center provider headquartered in Minnesota, announced plans in February 2024 to spend $100 million building the 100 MW Bicoion mining facility on a 42-acre site in industrial park.

The company stated it hoped the data center’s capacity can eventually be extended to 400MW. Port Muskogee recently installed a new 1,000MW electricity substation nearby.
