Feds appeal Datoka Access pipeline ruling

 

A federal judge’s decision to award North Dakota $28 million in damages for the executive branch’s response to the Dakota Access Pipeline protests is being appealed by the U.S. Justice Department.

North Dakota sued the government in 2019 claiming that the Army Corps of Engineers had unlawfully allowed protesters of the Dakota Access Pipeline to use its land at the state’s expense.

Most of the land where thousands of native Americans and other protesters gathered was Corps land.

Three months ago, U.S. District judge Dan Traynor agreed with the state and ruled the Army Corps was at fault for negligence, public nuisance and civil trespass claims.
