Evergy moves ahead with coal-delivery fight against BNSF railway

Evergy’s fight with BNSF railway over a failure to deliver coal to its power plants in 2022 just jumped in value.

The Kansas utility now claims $55 million in damages, not the $22 million as OK Energy Today first reported in June. The firm went to the Surface Transportation Board in 2024 and accused BNSF of not delivering coal from Wyoming’s Powder River Basin to its coal-fired plants, the Lawrence Energy Center in Lawrence, Kansas and the Iatan Station at Weston, Missouri.

In filings with the Board, Evergy claimed the $55 million in damages were caused by “lost profits and opportunity costs that exceed $20,000,000 before interest and additional power purchase and other incurred costs in excess of $35,000,000 before interest.”
