Supreme Court Justice recuses from oil railway case

The controversial Unita Basin Railway, the one that would transport oil from Utah, across Colorado and eventually to the Cushing Hub in Oklahoma, prompted U.S. Supreme COurt Justice Neil Gorsuch to recuse himself this week from the case.

Arguments are scheduled for Dec. 10 but Gorsuch once was an attorney for Denver  billionaire Philip Anschutz, who has an interest in the case. Anschutz Exploration Corp. is involved in oil production Colorado, Utah and Wyoming filed an amicus brief in support of the railway that is opposed by some western Colorado counties and state leaders.

CNN reported attorneys were notified by letter of the recusal. A report by Trains indicated Democratic lawmakers who urged Justice Gorsuch to remove himself from the case, applauded his decision.
