Groups claim New Mexico’s oil and gas permits violate state constitution

Constitutional Challenge to Trump Tax Repatriation Law to be Argued  Tomorrow in Ninth Circuit - Competitive Enterprise Institute

 

New Mexico, the second-largest oil-producing state in the nation, was sued this week by environmental groups and youth activists who contend the state is violating its constitution by permitting oil and gas production and failing to enforce pollution laws.

The groups, that include individuals from the Pueblos, the Permian Basin and Navajo Nation, contend they have a right to a “healthful and beautiful environment.”

Specifically, they claim the state, by issuing oil and gas drilling permits, is violating its duty laid out in a 1971 amendment Article XX Section 21 of the constitution reported Source New Mexico.
