Gas company wins Federal Appeals court case in Colorado

 

A Colorado natural gas producer prevailed Wednesday in an appeal over a class action settlement over royalty agreements, with the Tenth Circuit finding that jurisdiction existed despite an earlier, related state-court settlement.

TEP Rocky Mountain LLC settled a lawsuit brought in 2006 in Colorado state court by class representatives Ivo Lindauer, Sidney Lindauer, Ruther Lindauer, and Diamond Minerals LLC over allegedly unpaid royalties from wells.

Eight years after that settlement, a subset of that class sued TEP again over the calculation of royalties, this time in federal court, resulting in yet another proposed settlement agreement.
