Lawsuit over lost truck moved to OKC federal court

A breach of contract lawsuit filed by Cross Oil Co. of Kay County against Rush Truck Centers of Tulsa has been transferred from Tulsa federal court to the Western District in Oklahoma City.

Judge John E. Dowdell made the ruling at the request of Cross Oil.

Cross filed suit over work performed on one of its trucks which caught fire and also burned an office building and other equipment. The loss was estimated at $500,000 and Cross, in its lawsuit alleged Rush Truck Centers failed to perform maintenance on the truck in a workmanlike manner.

Rush attempted to have the case dismissed but Judge Dowdell ruled against the move and approved the request by Cross to move the case to Oklahoma City federal court.
