Supreme Court sides with Bristow tire recycling company

The Oklahoma Supreme Court has upheld a Creek County judge’s ruling against a former employee of Oklahoma Tire Recyclers, LLC who sued after being fired in 2016.

The appeal by Thomas Southon claimed he was fired a month after being hurt on the job at the Bristow company because he had filed a claim for workers’ compensation benefits. He also contended that part of state law governing discrimination was unconstitutional.

Seven justices upheld the lower court dismissal saying Southon failed to meet the burden required to establish that Section 7 of state law is unconstitutional.
