Elk City energy firm takes two companies to federal court in New Mexico

A New Mexico federal magistrate is giving more time to a Texas company in a lawsuit filed by Elk City-based Big Chief Plant Services Inc.

Panhandle Maintenance LLC, headquartered in Borger, Texas is fighting the move of a lawsuit from state to U.S. District court in New Mexico.

U.S. Magistrate Stephan M.  Vidmar, in a ruling this month gave Panhandle Maintenance until Jan. 24 to lay out the facts more clearly on the citizenship of Big Chief Plant Services as well as Panhandle Maintenance. The judge explained that determining the citizens of a Limited Liability Company is different that determining that of a corporation.

The lawsuit was filed by Big Chief against Panhandle Maintenance and 3 Bear Delaware Operating-NM LLC based in Denver, Colorado.

Big Chief filed a breach of contract lawsuit Nov. 20, 2018 and accused the two firms of violating New Mexico’s Unfair Practices Act. Founded in 2015 by Chad and Brad Marcum in Edmond, the company later moved and expanded in Elk City where its headquarters are now located.
