States Push Ahead with Legal Fight Against EPA’s Clean Power Plan

Updating the legal fight that 24 states have with the Environmental Protection Agency over the agency’s carbon emissions reduction plan on new power plants, the states are asking the D.C. Circuit to review EPA’s rejection of their plea.

It was last fall when the states filed lawsuits challenging the President’s environmental agenda and his signature climate change rule for the power plants. Oklahoma is not one of the states but the list includes Texas, West Virginia, Kansas, Missouri and Colorado.

The most recent filing contends the EPA improperly rejected the states request. West Virginia Attorney General Patrick Morrisey is leading the legal fight that accuses the EPA of going beyond its authority granted by Congress.

The EPA still contends its Clean Power Plan is legal and will withstand any challenge in court.
