Judge Reconsiders Sanctions in $21 million Pollution Lawsuit

A federal pollution lawsuit totaling nearly $21 million dollars to be paid BY FAG Bearings of Joplin, Missouri gets a new twist.

U.S. District Court Judge Greg Kays in Missouri has now agreed to reconsider the ruling he made one year ago in which he ordered the legal counsel of a woman who won $20.6 million pollution lawsuit to reimburse FAG Bearings’ attorneys. The June 2015 order was among sanctions against the attorney. The ruling involves Jodelle Kirk’s lawyer who won the lawsuit for the 27-year old woman who claimed her long list of health problems was due to trichloroethylene exposure from the FAG Bearing plant.

The woman contended FAG Bearings had dumped solvent used in cleaning metal parts around its property starting in 1971 and it was near her childhood home. The judgment included $13 million in punitive damages and $7.6 million in actual damages.
